Noize Soundworks, S.L. ("NOIZE", "we", "us") operates this store and website, including all related information, content, features, tools, products and services (the "Services"). NOIZE is powered by Shopify, which enables us to provide the Services to you.

This Privacy Policy explains how we collect, use and disclose your personal information when you visit or use the Services, make a purchase, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy prevails as regards the collection, processing and disclosure of personal information.

2. PERSONAL INFORMATION WE COLLECT

"Personal information" means information that identifies you or can reasonably be linked to you. It does not include anonymous or de-identified information. Depending on how you interact with the Services, we may process:

  • Contact details: name, billing address, phone number and email address.
  • Payment information: payment method, transaction details, payment confirmation and partial card data. We never store full card numbers; payments are processed directly by our payment providers.
  • Account information: username, password (encrypted), preferences and settings.
  • Transaction information: products viewed, added to cart or to a wishlist, purchased, refunded or cancelled, and your order history.
  • Communications: the content of your messages when you contact support, request a service or leave a review.
  • Device information: device, browser, network connection, IP address and other unique identifiers.
  • Usage information: how and when you interact with and navigate the Services.

3. PURPOSES AND LEGAL BASES

For each purpose we indicate the legal basis under Article 6 of the GDPR and the retention period:

  • Processing orders, delivering downloads, managing your account, providing support and managing refunds. Legal basis: performance of a contract (Art. 6.1.b). Retention: for the duration of the relationship.
  • Complying with tax, accounting and consumer law obligations. Legal basis: legal obligation (Art. 6.1.c). Retention: 6 years under the Spanish Commercial Code; 4 years for tax purposes.
  • Sending marketing emails and newsletters. Legal basis: your consent (Art. 6.1.a), or legitimate interest in respect of existing customers and similar products (Art. 6.1.f and Art. 21.2 LSSI). Retention: until you unsubscribe.
  • Advertising and measurement through third-party platforms such as Meta, including audiences and conversion tracking. Legal basis: the consent you give in our cookie banner (Art. 6.1.a). Retention: as set by each platform.
  • Analytics and improvement of the Services. Legal basis: consent for non-essential cookies; legitimate interest for aggregated statistics (Art. 6.1.f). Retention: up to 26 months.
  • Security, fraud prevention and defence of legal claims. Legal basis: legitimate interest (Art. 6.1.f) and legal obligation. Retention: for the duration of the applicable limitation period.
  • Publishing the reviews you submit. Legal basis: your consent (Art. 6.1.a). Retention: until you request removal.

Where we rely on legitimate interest, we have assessed that our interest in operating, securing and promoting our business does not override your rights and freedoms. You may object at any time (see Section 7).

4. RECIPIENTS AND DISCLOSURES

We disclose personal information to the following categories of recipients, always under a data processing agreement or an equivalent legal basis:

  • Shopify Inc., as the platform hosting the store and processing orders.
  • Payment providers (for example Shopify Payments, PayPal and, where applicable, Shop Pay), which act as independent controllers for payment and fraud-prevention purposes.
  • Marketing and advertising platforms, in particular Meta Platforms (Meta Pixel and Conversions API), for measurement and personalised advertising, where you have consented.
  • Review platforms (Loox), for collecting and publishing product reviews.
  • Email marketing and analytics providers, for sending communications and measuring traffic.
  • Professional advisers (accountants, lawyers) and public authorities, where required by law or to defend legal claims.
  • Third parties in connection with a corporate transaction, such as a merger, acquisition or insolvency.

We do not sell your personal information.

Shopify may use information about your interactions with our store, together with information from other merchants, to provide and improve its own enhanced features. 5. INTERNATIONAL TRANSFERS

Some of our providers are located outside the European Economic Area. Where personal information is transferred outside the EEA, we rely on recognised transfer mechanisms — an adequacy decision of the European Commission, the EU–US Data Privacy Framework where applicable, or the European Commission's Standard Contractual Clauses together with any additional safeguards required.

  • Rectification of inaccurate information.
  • Erasure of your information, where it is no longer necessary.
  • Restriction of processing in certain circumstances.
  • Portability: to receive your information in a structured, commonly used, machine-readable format and to have it transmitted to another controller.
  • Objection to processing based on our legitimate interest, including profiling for advertising purposes.
  • Withdrawal of consent at any time, without affecting the lawfulness of processing carried out before withdrawal.
  • Not to be subject to automated decisions producing legal effects on you. We do not make such decisions.

Marketing: you can unsubscribe from our commercial emails at any time using the link included in every message. We may still send you transactional messages about your orders.

Complaints: if you believe your rights have not been respected, you may lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, C/ Jorge Juan 6, 28001 Madrid, www.aepd.es) or with the supervisory authority of your country of residence. 8. CHILDREN'S DATA

The Services are not directed at children and we do not knowingly collect personal information from persons under the age of majority in their jurisdiction. If you are the parent or guardian of a child who has provided us with personal information, contact us and we will delete it.

9. SECURITY

We apply technical and organisational measures appropriate to the risk, including encrypted connections, access control and the use of providers with recognised security standards. However, no measure is completely secure and we cannot guarantee absolute security. Please do not send us sensitive or confidential information through insecure channels.

You are responsible for keeping your account credentials confidential and for not sharing them with third parties.

The Services may contain links to websites operated by third parties. We do not control them and are not responsible for their privacy or security practices. Please review their policies before providing them with your information. The inclusion of a link does not imply endorsement.

We may update this Privacy Policy to reflect changes in our practices or for operational, legal or regulatory reasons. We will publish the updated version on this page, update the "Last updated" date and, where the law requires it, notify you directly.
