This Legal Notice sets out the information required by Article 10 of Spanish Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE), and governs access to and use of the website noizesounds.com (the "Website").

Hereinafter, "NOIZE", "the Company", "we", "us" or "our".

Business activity: development, production and online sale of digital audio products (sample packs, loops, one-shots, MIDI files and synthesiser presets) and the provision of music production services (ghost producing, mixing and mastering).

2. PURPOSE

This Legal Notice regulates access to, browsing of and use of the Website. Browsing the Website grants you the status of user and implies full and unreserved acceptance of every provision of this Legal Notice, in the version published at the moment of access.

Purchases made through the Website are additionally governed by our Terms of Service, our Refund Policy and, as regards the use of the digital products supplied, our Sample License Agreement (EULA). Personal data processing is governed by our Privacy Policy and our Cookie Policy.

3. CONDITIONS OF USE

You undertake to use the Website and its contents lawfully and in good faith, and in particular not to:

  • use the Website for unlawful purposes or purposes contrary to good faith or public order;
  • introduce viruses or any other code capable of damaging the Website, its systems or those of third parties;

NOIZE may deny or withdraw access to the Website, without prior notice, to any user who breaches these conditions.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY

All contents of the Website — including but not limited to text, images, audio demos, waveforms, artwork, graphics, source code, layout, structure, trade names, trade marks and logos — are owned by NOIZE or by third parties who have licensed their use, and are protected by Spanish and international intellectual and industrial property law.

Access to the Website does not grant any right of ownership over its contents. Reproduction, distribution, public communication, transformation or any other exploitation of the contents is prohibited without the prior written consent of NOIZE.

The licence to use the audio products purchased through the Website is governed exclusively by the Sample License Agreement (EULA), which prevails over this section as regards those products.

7. APPLICABLE LAW AND JURISDICTION

This Legal Notice is governed by Spanish law.

For any dispute arising from access to or use of the Website, the parties submit to the Courts and Tribunals of the city of Madrid (Spain), unless a mandatory rule provides otherwise. If you are a consumer, this submission does not deprive you of the right to bring proceedings before, or to be sued only in, the courts of your place of residence, in accordance with Regulation (EU) 1215/2012 and the Spanish consolidated text of the General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007).
